Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Nirnay mobile application, website, or any related services (collectively, the "Service") operated by Shree Softech ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Service.

1. Description of Service

Nirnay is a daily Panchang and Choghadiya application that provides traditional calendar and astronomical information to users. The Service includes:

  • Daily and monthly Panchang details (date, day names, Gujarati lunar month, lunar phase known as Sud or Vad, Tithi, Nakshatra, moon sign, and notes).
  • Choghadiya timings for each day.
  • Festival information with names, descriptions, and images (with focus on Gujarati and Swaminarayan traditions).
  • Eclipse (Grahan) details.
  • Rashi information.
  • Inspirational quotes.
  • Push notifications for relevant events based on your timezone.

The Service is delivered primarily through our official mobile applications for Android and iOS (using APIs), and is also accessible via web. By using the Service you agree to these Terms.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you are at least 13 years old and have the legal capacity to enter into these Terms.

3. User Responsibilities and Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Attempt to gain unauthorized access to any portion of the Service, its systems, or networks.
  • Scrape, crawl, or harvest data from the Service using automated means without our prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Upload or transmit any material that contains viruses, malware, or other harmful code.
  • Use the Service to provide similar services to others without our permission.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

4. Intellectual Property Rights

The Service and its original content, features, functionality, calculations, designs, logos, text, graphics, and software are and will remain the exclusive property of Shree Softech and its licensors.

The panchang calculations and core data are powered by our proprietary systems and licensed third-party astronomical libraries. All rights are reserved.

You may not copy, modify, distribute, sell, or lease any part of our Service or included content without our prior written permission.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

5. Content and Data Disclaimer

The information provided through Nirnay, including but not limited to Panchang timings, Choghadiya, festival dates, and astrological data, is for informational, cultural, and religious guidance purposes only.

Important:

  • This Service does not constitute professional, legal, financial, medical, or astrological advice.
  • Traditional Panchang calculations are based on astronomical algorithms and classical texts. While we strive for high accuracy, we do not guarantee that the information will be error-free, complete, or suitable for any particular purpose.
  • You should not rely on the Service for making critical decisions (such as financial investments, medical procedures, legal matters, or major life events) without independently verifying the information from qualified professionals.
  • Regional variations in calendar calculations and festival observances may exist. Local customs and the guidance of your religious authorities should take precedence where applicable.

We reserve the right to correct errors and update data as needed without prior notice.

6. Third-Party Services and Links

Our Service may contain links to third-party websites or services that are not owned or controlled by us.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

Push notification services are powered by Firebase and other third-party providers. Your use of notifications is subject to their respective terms.

7. Mobile Application Terms

When you use our mobile applications for Android and iOS:

  • By enabling notifications, you agree that the app may use your device information and timezone to deliver relevant alerts (such as upcoming festivals or eclipses) at the proper local time.
  • You are responsible for the accuracy of the information you see in the app and for any decisions you make based on it (see the Content Disclaimer below).
  • You may be asked to grant notification permissions and optionally location access for better local timings.
  • You are responsible for maintaining the security of your own device.
  • We may update the app from time to time. Your continued use after an update means you accept the current version.
  • The app may show update prompts or maintenance notices when required.

8. Communications and Notifications

By using the Service, you consent to receive communications from us, including push notifications, emails, or other messages regarding updates, festivals, important announcements, and service-related information.

You may manage notification preferences through your device settings or within the application where available.

9. No Warranty / Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.

We do not warrant that the data provided (including astronomical timings and traditional calculations) will be accurate, reliable, or complete at all times.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Shree Softech, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service;
  • Unauthorized access, use, or alteration of your transmissions or content;
  • Decisions made or actions taken based on information obtained from the Service.

In no event shall our total liability exceed the amount you paid us (if any) for using the Service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to defend, indemnify, and hold harmless Shree Softech and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use of and access to the Service, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bhuj, Gujarat, India.

13. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

14. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

15. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shree Softech regarding the Service and supersede all prior agreements and understandings.
